O artigo analisa a responsabilidade criminal de agentes que atuam com base em parecer técnico especializado, cujo caso de referência é o rompimento de um aquário gigante em Berlim em 2022 o qual lesionou duas pessoas, matou diversos peixes e implicou danos estruturais à DDR. A investigação policial suspeitou que o rompimento tenha sido causado por uma rachadura no material, provavelmente em razão das baixas temperaturas. Para atingir o objetivo proposto, o artigo explora questões como causalidade, imputação objetiva e a influência do parecer técnico no elemento subjetivo e sua influência no erro de tipo. A teoria da causalidade é discutida a partir da perspectiva brasileira, com base na teoria da conditio sine qua non, considerando se a conduta do dono do hotel foi necessária para o resultado. A imputação objetiva, segundo a teoria do risco, é aplicada para verificar se a criação do risco foi juridicamente desaprovada e se o resultado violou a norma. Além disso, são discutidos os critérios para confiar em um parecer técnico, destacando a importância de fontes confiáveis e imparciais. A influência do parecer na formação do elemento subjetivo é analisada, sugerindo que o erro de tipo pode excluir o dolo se o parecer técnico for considerado confiável.

The article analyzes the criminal responsibility of individuals who act based on specialized technical opinions, using the 2022 rupture of a giant aquarium in Berlin as a case study. The incident injured two people, killed several fish, and caused structural damage to the DDR museum. The police investigation suspected the rupture was caused by a crack in the material, likely due to low temperatures. To achieve its goal, the article explores issues such as causation, objective imputation, and the influence of technical opinions on the subjective element and their impact on the abscense of mens rea. The theory of causation is discussed from a Brazilian perspective, based on the conditio sine qua non theory, considering whether the hotel owner's conduct was necessary for the result. Objective imputation, according to the risk theory, is applied to determine whether the creation of risk was legally disapproved and whether the result violated the norm. Furthermore, the article discusses the criteria for trusting a technical opinion, emphasizing the importance of reliable and impartial sources. The influence of the opinion on the formation of the subjective element is analyzed, suggesting that lack of knowledge of an element of the offense can exclude intent if the technical opinion is considered trustworthy.
