The provisional release in view of expulsion: The decision-making process of the Sentence Implementation
Courts
In Belgium provisional release for deportable foreign national prisoners is enacted in the 2006 Sentence
Implementation Act. At present, the Sentence Implementation Courts take their decision based on three
different contraindications. Based on semi-structured interviews, this article examines the aim of the
decision-making process of the Dutch-speaking Sentence Implementation Courts and the public prosecutors attached to this when deciding on provisional release for deportable foreign national prisoners.
We will argue that although social reintegration is a key concept of Belgian sentence implementation,
Sentence Implementation Courts are limited in its realisation.
