abstract

The rapid growth of artificial intelligence is transforming the criminal justice system,
prompting significant interest and debate in the academic literature. This paper
presents the diverging views within the judicial field, highlighting the promises and
challenges of technological integration. It advocates for a comprehensive framework
that examines the complex relationships among the creators and users of technological
tools, allowing us to move beyond a purely instrumental view of technology, and to
instead consider it as an active and integral part of the criminal process. This approach
challenges simplistic, linear perspectives, and encourages a more nuanced
understanding of 'e-justice' in the digital age.
