In the case of ‘Intertanko’ C-308/06, the European Court of Justice (ECJ) has reviewed the compatibility of article 4 of the Directive 2005/35 on ship-source pollution with the principle of nullum crimen nulla poena sine lege certa (lex certa), which is the expression of the general principle of legal certainty in criminal law matters.
